ALBANY -- The Appellate Division of state Supreme Court ruled unanimously that the Independence Party State Committee was within its power to oust party
Chairman Jack Essenberg and five members of his executive committee.
Wednesday's decision -- a reversal of an earlier decision by a lower court -- places Frank MacKay of Suffolk County in the leadership position for Monday's
state convention in Albany.
